California's $17.40 Minimum Wage Passes Oakland's Current Rate Jan. 1: What Changes

OAKLAND, CA — All year, Oakland's minimum wage has sat 44 cents above California's. On January 1, 2027, that cushion disappears, at least on paper. The state's minimum wage rises to $17.40 an hour that morning, six cents above the $17.34 Oakland has required since the start of this year. From Fruitvale to West Oakland, the new year brings numbers worth checking.

California's 2027 minimum wage of $17.40 passes Oakland's current local rate, and the state's overtime-exempt salary floor climbs to $72,384. Here is what changes on January 1 and what it means for your paycheck and your job search.

💵 California's 2027 Minimum Wage Is $17.40

The state Department of Industrial Relations announced the increase in August, after the Department of Finance certified the inflation adjustment on July 31. It is a 50-cent raise from this year's $16.90, and it covers every employer in California regardless of size.

Oakland's own floor is set by Measure FF, the ordinance voters passed in 2014, and the city adjusts it every January 1 for inflation. As of this week, the city's Department of Workplace and Employment Standards still lists $17.34 and has not posted a 2027 figure.

When the State and the City Disagree, the Higher Rate Wins

Whether you work a register on Broadway or a warehouse shift near the airport, the rule is simple. When state and local minimums differ, your employer owes you whichever one is higher.

So come January 1, no one working in Oakland should be paid less than $17.40 an hour. If Oakland's inflation adjustment lands above that, the city's number becomes the floor instead. Either way, $17.34 stops being a legal wage in Oakland on New Year's Day.

The same rule applies across the city line. Berkeley and Emeryville already sit well above $17.40, so the state change does not touch them until their own July 1 adjustments. Our East Bay wage line breakdown explains why the address where you work, not where you live, decides your floor.

Salaried? Check the $72,384 Line

The minimum wage also moves a number that gets far less attention. In California, most salaried workers can only be classified as exempt from overtime if they earn at least twice the state minimum wage for full-time work. At $17.40, that comes to $72,384 a year, up from $70,304 in 2026.

Assistant managers, office supervisors and coordinators sitting just under that line are the ones to watch. An employer can raise the salary above $72,384, or reclassify the job as hourly and pay overtime past eight hours a day or 40 a week. Salary is only half the test, too. The job's actual duties also have to qualify for an exemption.

A Floor, Not a Going Rate

None of this means $17.40 is what Oakland employers are offering. The Bay Area market runs above the legal minimum in most fields. The floor matters most for entry-level counter work, small independent shops and part-time schedules. Check your first paystub of 2027, and aim for jobs that clear the floor by a wide margin.
